Minister of Justice Gürlek, in his speech at the iftar program organized by Ankara No. 2 Bar Association at ATO Congresium, wished that Ramadan would bring goodness to Türkiye and the Islamic world.

Stating that the prosecutor represents the claim, the judge represents the decision, and the lawyer represents the defense, Gürlek stated that if one of these three elements is weak, justice will be lacking.

Gürlek reminded that the Law on Lawyers defines the lawyer as the founding element of the judiciary, and emphasized that the Turkish Penal Code counts lawyers among the persons performing judicial duties and that lawyers are the guarantee of the rule of law.

Stating that lawyers have a great role in the success achieved especially in areas such as mediation and conciliation, Gürlek continued as follows:

“In recent years, we have taken important steps to strengthen the legal profession. We introduced the Legal Professions Entrance Exam. We made arrangements to increase the quality in law faculties. We implemented the e-trial system and enabled lawyers to participate in the trials from where they are. We expanded the UYAP integration, introduced the hearing application, reduced the VAT rate on some legal services. We introduced bar association deductible exemption and financial support for lawyers who are new to the profession. We increased legal aid revenues. They listen to the voice of the defense. “These are the regulations that have been given and implemented.”

Gürlek stated that strengthening the legal profession is possible not only with individual regulations but with a holistic approach.

For this purpose, Gürlek explained that they immediately started working to address the Law on Lawyers in a more comprehensive manner and said:

“As one of the main objectives of strengthening the defense in the Judicial Reform Strategy document, we will update the Law on Lawyers in the coming period, expand the powers of lawyers to unite, cooperate and obtain documents, and make arrangements to support trainee lawyers. Our aim is to prepare an environment where lawyers can practice their profession safely, respectfully and effectively. Strengthening the defense means strengthening the judiciary. Strengthening the judiciary means strengthening justice. Justice comes to life as a whole with the judge’s verdict, the prosecutor’s claim and the lawyer’s defense. “THE NEED FOR A NEW CONSTITUTION IS NOT A POLITICAL PREFERENCE, BUT A SOCIAL NECESSITY”

Gökhan Ağdemir, President of Ankara Bar Association No. 2, stated that Ramadan is not only about fasting, but also about educating the soul, purifying the heart and making people bond more closely to each other.

Stating that the legal profession is the honorable representation of the struggle for rights, Ağdemir emphasized that lawyers are the founding elements of the judiciary.

“Our current constitutional system was prepared under extraordinary period conditions, revised with many changes, but could not turn into a new social contract that provides integrity. The need for a new constitution is not a political choice, but a social obligation. Because the constitution is the written expression of the common will of the nation. The new constitution should embrace a Terror-free Türkiye in peace and tranquility with a text that unites, does not create uncertainty, and gives confidence. Türkiye’s need is not a vision that reckons with the past, but a vision that builds the future. Underlining that one of the most common problems faced by the judicial system is the failure to finalize the files within a reasonable time, and that this causes serious grievances to both citizens and lawyers, Ağdemir said that they will find it valuable that the “Alo Justice” system to be implemented will control the delays.
