It was decided to reject the lawsuit filed in the Ankara 3rd Civil Court of First Instance, demanding that all decisions taken at the CHP 38th Ordinary Congress and the Istanbul Provincial Congress be annulled and the congress and congress be deemed as absolute null and void.

At the hearing at Ankara 3rd Civil Court of First Instance, defendant CHP’s lawyer Kadri Gökhan Sultan was present, while plaintiff’s lawyer Onur Yusuf Üregen excused himself and did not attend the hearing. The trial judge stated that the plaintiffs, who wanted the cancellation of the Istanbul Provincial Congress, waived their case. Later, the promised lawyer Sultan requested the rejection of the case. Announcing his decision, the judge rejected the request for cancellation of the Istanbul Provincial Congress due to the waiver of the case. A lawsuit was also filed at the Ankara 3rd Civil Court of First Instance, claiming that “the will of the delegates was corrupted by providing benefits to the delegates” at the CHP 38th Ordinary Congress and the Istanbul Provincial Congress, demanding that all decisions taken be annulled and that the congress and congress be deemed as null and void.

At the hearing held on September 11, 2025, the court decided to reject the case on procedural grounds, on the grounds that the 38th Ordinary Congress case held on November 4-5, 2023 continued in Ankara 42nd Civil Court of First Instance, and that there was currently an ongoing case on the same issue. Additionally, the court ruled to reject the case filed against CHP Istanbul Provincial Directorate due to “absence of passive hostility”.

The file was moved to the court of appeal after the plaintiff’s attorney, lawyer Onur Yusuf Üregen, objected to the decision. The 4th Civil Chamber of the Ankara Regional Court of Justice found the local court’s decision to reject the case on the grounds of “absence of passive hostility” as “contrary to the right to be heard” because the judgment was made in the absence of the excused plaintiff party.

The chamber stated that making a decision before the legal deadlines for the parties to present their evidence was a procedural error, and decided to revoke the decision of the Ankara 3rd Civil Court of First Instance and reheard the file.
