KARA’S NEPHEW CARRIED OUT THE BRIBERY ACTIVITIES

In the reasoned decision, it was clearly emphasized that former CHP Mayor Niyazi Nefi Kara, who took office on March 31, 2024 and was suspended from his post by the Ministry of Internal Affairs within the scope of the investigation, was the “Organization Leader”. According to the decision, Kara liquidated honest municipal staff as soon as he took office. He replaced them with relatives and trusted relatives who would run the wheel he established smoothly. It has been proven that Mayor Kara, in order to keep himself in the background, positioned his own nephew Hüseyin Cem Gül, who has no official position or title in the municipality, as an “unofficial manager” and carried out all the cash bribe negotiations through this nephew.

500 THOUSAND EUR VILLA AND LUXURY RANGE ROVER FOR HIS SON IN EXCHANGE FOR BRIBE

The robbery worth millions of euros was documented one by one with technical and physical monitoring and MASAK reports. It was determined that the leader of the organization, Niyazi Nefi Kara, tried to hide the payment for the luxury villa he bought at Lions Life Site on May 14, 2024, by saying, “It was the cash I had left over from the election, I did not withdraw it from the bank.” However, the seller’s statement revealed the truth. It was proven that the villa was sold for 500 thousand euros in return for bribe money and that the chairman’s nephew, Hüseyin Cem Gül, personally delivered the cash during the handover of the title deed. It was determined that a luxury Range Rover brand vehicle was purchased as a birthday present for the president’s son, Ali Çağın Kara, with the bribe money collected from hotels and businessmen, and all insurance transactions of the vehicle were also carried out by the bribery network.

THEY PAID MILLIONS OF EUROS WITH THE PASSWORD “WE RECEIVED THE TRUST”

It was determined that the network used special passwords among themselves to avoid being wiretapped. When the bribe money extorted from businessmen was received, it was reflected in the phone records that the organization managers called President Kara and used the password “We have received the trust”. It was explained in great detail that the occupancy and license applications of hoteliers who did not pay bribes were deliberately kept under wraps for months, and that businessmen were forced to transfer money to front companies belonging to the network, saying “The municipality has a debt”. It was reported that exorbitant fines were imposed on hoteliers who did not submit to the demands of the network, using police force.

“TEAM A” OF ORGANIZED CRIME NETWORK

In the reasoned decision, the organized network was defined as a ‘Criminal Organization for Interest Purposes’. Mayor Niyazi Nefi Kara took part in the scheme as the leader of the organization. Nephew Hüseyin Cem Gül was included in the scheme as the ‘organization manager’. Yegen Gül was the main actor in the scheme that carried out zoning, license and settlement transactions in exchange for bribes, without having any official duties. Another organization manager, Sıla Ceylan Berkaya, was Mayor Kara’s relative and the Deputy Mayor responsible for Development and Settlement.

The organization manager, Mehmet Engin Tüter, was the Deputy Mayor in Charge of Police. He was coordinating the police crackdown and coordinating the profiteering by collecting fake invoices through front companies. It was also determined that Bulem Shahbaz, another nephew of the President and his Chief of Staff, changed the hard drives of municipal security cameras in order to obscure evidence of bribery.

PUNISHMENT WAS PUNISHED ON THE DEFENDANTS

Organization Leader President Niyazi Nefi Kara was sentenced to a total of 46 years, 10 months and 15 days in prison and a judicial fine of 2.5 million liras for the crimes of “establishing and managing an organization”, “chain bribery”, “extortion”, “embezzlement” and “laundering of criminal assets”. Former Deputy Mayor Mehmet Engin Tüter was sentenced to a total of 40 years in prison and a judicial fine of 2 million lira for the crimes of “establishing and managing an organization”, “chain bribery”, “extortion”, “embezzlement” and “laundering of criminal assets”.

The detained defendant, Hüseyin Cem Gül, was sentenced to a total of 41 years and 9 months in prison for the crimes of “establishing and managing an organization”, “taking bribes”, “chain extortion”, “embezzlement” and “laundering of assets resulting from crime”.

Detained defendant Mesut Kara was also sentenced to a total of 24 years and 2 months in prison and a judicial fine of 1.4 million lira for the crimes of “being a member of a terrorist organization”, “taking bribes”, “extortion” and “laundering property values ​​resulting from crime”.

While the court decided to confiscate the foreign currency seized in the baklava box, it also decided to confiscate the gold, foreign currency and some real estate seized within the scope of the investigation.

Work was initiated after President Recep Tayyip Erdoğan’s statement during his visit to the city on July 9, 2021, “We are soon evacuating Diyarbakır Prison, which has been associated with cruelty, torture and inhumane treatment for a long time in the past, and present it to you as a cultural center.” Following the protocol signed between the Ministry of Justice and the Ministry of Culture and Tourism on October 11, 2022, the restoration work of Diyarbakır Prison, which was transferred to the Provincial Directorate of Culture and Tourism, started.

It was converted into a Memorial and Ethnography Museum by the Ministry of Culture and Tourism and the cells and wards were rearranged. Pictures from the old period were prepared and representative sculptures depicting the visitors were made. President Recep Tayyip Erdoğan is expected to open the museum, which is expected to be completed completely by the new year.

His paintings from the archives of the General Directorate of Prisons and Detention Houses also took their place in the museum. Among the pictures are Prison Commander Captain Esat Oktay Yıldıran, known for his bad practices in Diyarbakır Prison, and his dog Joe.
