‘Advertising use’ warning from KVKK: Explicit consent of the relevant persons must be obtained!

KVKK announced the Public Announcement on the Use of Personal Data Obtained from Third Parties for Advertising and Marketing Purposes on the institution’s website.

In the announcement, it was stated that various notices and complaints were made to the institution regarding data controllers operating in various sectors using the contact information they obtained from their customers or third parties for advertising and marketing purposes.

The announcement emphasized that the fact that personal data was obtained from third parties does not provide a direct legal basis for data controllers to process this data for advertising and marketing purposes, and pointed out that these activities must be carried out in accordance with the Personal Data Protection Law No. 6698.

The announcement noted that the purpose of Law No. 6698 is to protect the fundamental rights and freedoms of individuals in the processing of personal data and to regulate the procedures and principles that real and legal persons who process personal data must comply with.

“Pursuant to the law, as a rule, personal data cannot be processed without the explicit consent of the relevant person, but if one of the legal processing conditions listed in Article 5 of the Law is met, it is possible to process personal data without the explicit consent of the relevant person. In this respect, it should not be forgotten that the personal data processing condition in terms of advertising and marketing activities should be evaluated separately for each concrete case.

On the other hand, in accordance with Article 10 of the Law, data controllers, during the acquisition of personal data, can; “It is obliged to inform the data controller about the identity of the data controller, the purpose of processing personal data, the persons and purposes to whom the processed personal data can be transferred, the method and legal reason for collecting personal data, and the rights of the relevant person under the Law.”

“FIRST, THE OBLIGATION TO CLARIFY MUST BE FULFILLED, THEN EXPRESS CONSENT SHOULD BE OBTAINED”

In KVKK’s announcement, it was stated that the procedures and principles to be applied in cases where personal data are not obtained directly from the relevant person are regulated in the Communiqué on the Procedures and Principles to be Followed in Fulfilling the Notification Obligation.

In the announcement, it is stated that despite the regulations in the Communiqué, direct marketing calls are made through call centers with contact information obtained from third parties. “Data controllers must first fulfill their obligation to inform, and then, when necessary, obtain the explicit consent of the relevant person through a separate statement of intent.” expressions were used.

In the announcement, it was stated that it is mandatory for personal data processing activities to be carried out in accordance with the law, and the following 6 articles and warnings were listed:

“- In cases where personal data cannot be obtained directly from the relevant person, fulfilling the obligation to inform in accordance with Article 6 of the Communiqué in a timely and proper manner, – Informing the relevant persons in a clear, understandable and complete manner about the processing processes of their personal data, – In personal data processing activities based on explicit consent; the explicit consent must be based on a certain subject, based on information and expressed with free will, – The behaviors of the relevant persons, such as continuing to listen to the campaign, not ending the conversation, requesting information or not responding to an SMS, are only “In accordance with the provisions of the Communiqué, the obligation to inform and the processes of obtaining explicit consent must be carried out independently of each other, – In all personal data processing processes carried out within the scope of advertising and marketing activities, the provisions of the Law and relevant legislation must be complied with and the fundamental rights and freedoms of the relevant persons must be observed.”

In KVKK’s announcement, it was stated that administrative sanctions may be imposed within the scope of Article 18 of Law No. 6698 on data controllers who are found to have acted contrary to the obligations stipulated in the Law.

Making a statement to the press about the Vessel Traffic Services System established in the Famagusta district of TRNC within the scope of the Eastern Mediterranean Vessel Traffic Services Project, Nacar said that the system has an integrated structure in which foreign ship movements, human smuggling and illegal operations can be detected, thanks to the local software integrated with radars, electronic systems, communication infrastructure and towers installed in the field.

Stating that the digital ship surveillance system made by HAVELSAN has a higher localization rate than those made in the past, General Manager Nacar said, “The system can work integrated with our existing systems and raises situational awareness to higher levels with its artificial intelligence-supported analysis ability.” he said.

Nacar reminded that HAVELSAN replaced foreign software with local ones in the Turkish Straits Vessel Traffic Services in 2023 and reinforced the sensors with local products, and emphasized that the system installed in the TRNC went one step further than its predecessors with a higher localization rate.

Emphasizing that the Vessel Traffic Services System established in the TRNC within the framework of the Eastern Mediterranean Vessel Traffic Services Project will be the eye of both Türkiye and the TRNC in the “Blue Homeland”, Nacar said:

“Thanks to this system, what is happening here can be detected and viewed much more easily. This will allow us to act more freely. We will provide situational awareness at sea with our own systems, without depending on others. TRNC will benefit from this system to the maximum extent in terms of smuggling, illegal activities and the safety of ship traffic.”

Pointing out that an important digital maritime surveillance system has been established in the TRNC, Nacar said, “The artificial intelligence-supported domestic digital maritime surveillance system installed in the TRNC will significantly increase maritime security in the Eastern Mediterranean ‘Blue Homeland’.” he said.

Stating that HAVELSAN has established similar coast guard, radar and surveillance systems in Türkiye and friendly countries, Nacar underlined that they also carried out projects in the Black Sea, Southeast Asia and Africa.

Nacar pointed out that HAVELSAN is turning to other fields with products such as aviation simulations, command control systems and battle management software, and said, “HAVELSAN will become even stronger in 2026 with new projects in the fields of big data, artificial intelligence and cloud computing.” he said.

Minister of Family and Social Services Mahinur Özdemir Göktaş evaluated the submission of the 18-article proposal to the Presidency of the Grand National Assembly of Turkey, which includes the Child Protection Law, which includes regulations for children driven to crime, and amendments to some laws, and explained the work carried out by the Grand National Assembly of Turkey Investigation Commission on Children Driven to Crime, which was established in this context.

Göktaş stated that the social structure has changed, the risks have diversified, and digitalization and new crime methods targeting children require a new perspective in this field, and added:

“With the new legislation, this is a very important regulation that aims to eliminate the perception of impunity and at the same time to implement preventive measures in the most effective way, especially before children are dragged into crime. It will continue to be discussed in the Parliament and in the Commission today. It is being discussed in our Justice Commission. Our aim is to protect and prevent our children from all kinds of risks and threats. Therefore, 75-80 percent of this new legal regulation envisages the implementation of protective and preventive measures in a more effective, strong and coordinated manner.”

“OUR AIM IS THAT OUR CHILDREN CAN LOOK AT THE FUTURE WITH MORE CONFIDENCE WITHOUT ENGAGING IN CRIME”

Minister Göktaş stated that the Ministry will undertake central coordination in the child protection system and ensure coordination among relevant institutions, and that they aim to early detect the risks of children being dragged into crime and to implement protective-preventive measures more effectively.

Göktaş noted that with the regulation, an emergency protection report can be prepared within 24 hours for the child determined to need treatment, and various obligations are imposed on families.

Stating that they want the proposal to become law as soon as possible, Göktaş said, “Our goal is for any of our children to be able to look to the future with more confidence without getting involved in crime, and if there is a possibility of getting involved in a crime, they will be rehabilitated and supported early.” he said.

FAMILY AND YOUTH FUND PAYMENTS ARE DEPOSITED TO ACCOUNTS TODAY

Mahinur Özdemir Göktaş drew attention to the decrease in the fertility rate and gave information about their efforts to encourage young marriages and increase the number of children.

Reminding that in this context, as of January 1, 2025, a one-time support of 5 thousand liras is given to the first child born, 1500 liras per month to the second child, and 5 thousand liras per month for the third and subsequent children, Göktaş said, “Hopefully, on July 29, our payments for this month will be deposited into the accounts. To date, we will have made payments of 22.5 billion liras to 1 million 175 thousand 601 mothers. 2 and over 3 mothers will receive a one-time support of 5 thousand liras. “We make regular payments for 700 thousand 541 children. Our aim is to strengthen the family-friendly ecosystem and create a mechanism where families are more comfortable and the burden of care is shared.” he said.

Göktaş stated that 2.8 billion liras will be paid to 24 thousand 946 young people as of today within the scope of the Family and Youth Fund, and that they have provided a total of 16 billion 797 million liras of support to date.

Emphasizing that they aim to provide income support to families and make working life easier with the Income Supplementary Family Support System, Göktaş said, “In this context, a very valuable work that can set an example not only for Türkiye but also for the world is being implemented. Our legislative work is almost completed. Our work is being followed on a weekly, monthly basis, and we hope to have it passed as a law according to the Parliament calendar when it reopens.” he said.

Reminding that he welcomed the expats who came to Türkiye to spend their annual leave on July 19 at the Kapıkule Border Gate, Minister Göktaş said that the emotional moments experienced by the citizens while passing through the border gate deeply affected him.
