Son dakika: Bakan Tunç’tan Selahattin Demirtaş açıklaması

Bakan Tunç, adalet sistemiyle ilgili dezenformasyonun, adalete güvensizliğe neden olduğunu belirterek, “Vatandaşlarımızın adalete güven duygusunun zedelenmemesi lazım. Özellikle yargıya güveni sarsmaya yönelik birtakım propagandalar da yapılıyor.” dedi.

Adalet Bakanı Tunç, basın mensuplarıyla bir araya geldiği toplantıda gündemdeki konuları değerlendirdi.

Yargıya yönelik dezenformasyonun asıl amacının güvensizlik oluşturarak hükümeti yıpratmak olduğunu ve bunun neticesinde milletin zarar gördüğünü Vurgulayan Bakan Tunç, yargıya güvenin önemine dikkati çekerek, bu konuda kamuoyunda infiale neden olan somut bir örneği paylaştı.

Toplumda endişe yaratan bir dezenformasyon örneğine değinen Bakan Tunç, “Bir gazeteci, ‘Ceren Özdemir’in katili açık cezaevine çıktı. Yakında topluma karışacak. Katiller aramızda dolaşıyor’ şeklinde bir yayın yaptı. Bu iddia milyonlarca kişiye yayıldı ve ‘İşte adalet! Türkiye’de hukuk yok’ gibi yorumlara neden oldu.” ifadelerini kullandı.

Bu iddianın kamuoyunda yarattığı telaş üzerine bir araştırma yaptıklarını belirten Tunç, şunları kaydetti;

Gördük ki, bu kişi hala yüksek güvenlikli cezaevinde ve çıkması mümkün değil. Ama ne oldu o yayın? Milyonlarca yayıldı. O yayının altına yorumlar yapıldı. İşte adalet! Türkiye’de hukuk yok vesaire. Tabii, ne oluyor o zaman? Adalete güven zedeleniyor. Vatandaşlarımızın adalete güven duygusunun zedelenmemesi lazım. Bazı basın mensupları var ki konuyu gazeteciliğin ötesine taşıyor. Başka bir amaç taşıyor. O, onun bir dezenformasyon olduğunu, yalan haber olduğunu aslında biliyor.

“Yargıya güveni sarsmaya yönelik propagandalar yapılıyor”

Her meslekte olduğu gibi yargının içerisinde yanlış yapanlar da olabilir. Ama bunun sistem içerisindeki ayrışmasını gene yargı kendisi yapar. Gazetecilikte de öyle. Özellikle yargı ile ilgili, adalet ile ilgili konularda yorum yaparken ya da bir sosyal medya paylaşımını gördüğümüzde hemen inanmamamız lazım. ‘Acaba, bu böyle mi?’ diye doğruluğunu tespit etmek lazım. Özellikle yargıya güveni sarsmaya yönelik birtakım propagandalar da yapılıyor.

Bakan Tunç, açıklamalarına şöyle devam etti;

(Siber suçlar) Bunlar internet yoluyla örgütleniyorlar. Mesela İzmir’deki polis cinayeti, 3 polis şehit oldu. 16 yaşındaki bir çocuk bunu yapan. Bu çocuk tamamen kendi içine kapalı, hiç ailesinin bile haberi olmadan bilgisayar başında resmen bir eğitim almış ama ona eğitim verenleri de tanımıyor. Tamamen dijital ortamda, internet ortamında görüştüğü, suratını görmediği, yazışmalardan etkilenip kendisini adeta bir örgüt mensubu gibi görüyor. En son yaptığı paylaşımda, ‘İşte ben’ diyor, ‘Gideceğim, katliam yapacağım’ vesaire diye mesaj atıyor. Babasının silahını alıyor ve orada polislerimizi şehit etti.

Burada hem bu tür suçlar hem işte uyuşturucu ticareti, sanal bahis, sanal kumar, yasa dışı bütün faaliyetler, yani artık bu teknoloji çağında dolandırıcılık, kripto para vesaire tüm bunlar internet ortamında yapılan eylemler. Şimdi bunlar gerçek hayatta yapılırsa zaten suç. Gerçek hayatta bunları kovalamak daha kolay ama dijital ortamda bunların izini sürmek kolay değil.

“Siber suçlar ülke sınırlarını aşıyor”

2 hafta önce Vietnam’daydık, Siber Suçlara Karşı Birleşmiş Milletler Sözleşmesi’ni imzaladık. Bütün ülkelerin problemi. Bu suçlar sadece ülke sınırında değil, ülke sınırını aşıyor. Dolayısıyla, ülkelerin tek başına mücadele etmesi mümkün değil. O zaman oturup bir sözleşme yapalım, bu konuda yasalarımızı düzenleyelim, birlikte mücadele edelim düşüncesi hasıl oldu ve biz 80 ülkenin bakanı oradaydık. İlk imzalayan ülkelerden birisiyiz.

Bizim 11. Yargı Paketinde bilişim suçlarıyla ilgili düzenlemelerimiz var. Bilişim yoluyla işlenen suçların önlenmesi, internet yoluyla işlenen suçların önlenmesine dair bir kanunumuz var ama o genelde kişilik hakları, sosyal medyadaki erişimin engellenmesi falan onları düzenliyor. Türk Ceza Kanunu’nda bilişim suçlarıyla ilgili yapılan düzenlemeler, daha detaylı yapacağımız düzenlemeler.

“Çocukları suça sürükleyenlerin cezaları artırılacak”

Sanal ortamda suç tespit edebilmek için, nasıl sokakta gece bekçiler var, polis devriye geziyor aynı devriyelerin sanal ortamda da gezmesi lazım siber polislerin. Nasıl açık alanda güvenliğe önem veriyorsak, siber alemde de güvenliğe önem vermemiz lazım.

Bizim bu konuda adliyelerde bilişim suçları büroları var. Yeni nesil suç şebekeleri dediğimiz, TCK 220’de yer alan düzenlememiz var. Milletvekillerimiz şu anda bunu teklife daha dönüştürmediler. 11. Yargı Paketinde olacak. Çocukları suça sürükleyen, suçta çocukları araç olarak kullananlarla ilgili cezaların arttırılması söz konusu.

Teklifle; örgüt kurmak, yönetmek ve örgüte üye olmak suçlarının hapis cezalarının alt ve üst sınırları artırılmaktadır. Böylelikle suçla daha etkin mücadele edilmesi ve toplumsal huzur ve sükûnun sağlanması amaçlanmaktadır. Buna göre; Örgüt kurma ve yönetme suçunun cezası 4 yıldan 8 yıla kadar hapis iken 5 yıldan 10 yıla çıkartılacak. Örgüt üyeliği suçunun cezasının üst sınırı 4 yıl hapis iken 5 yıl hapis cezası olarak belirlenmektedir.

Yine örgütün silahlı olması halinde cezada dörtte birinden yarısına kadar yapılan artırım, sadece yarısı oranında olacak şekilde düzenlenmektedir. Buna göre silahlı bir örgütü yöneten kişiye 5 yıldan 12 yıla kadar hapis cezası verilirken Teklife göre 7 yıl 6 aydan 15 yıla kadar hapis cezası verilebilecektir. Diğer yandan, örgütün faaliyeti çerçevesinde işlenen suçlarda çocukların araç olarak kullanılması halinde, örgüt yöneticilerine verilecek cezanın yarısından bir katına kadar artırılacağı kabul edilmektedir.

Örneğin örgüt faaliyeti çerçevesi çocuğa bir yeri silahla taratan, birini tehdit ettiren ya da yaralattıran örgüt yöneticisine yöneticilik suçundan dolayı verilecek ceza yarısından bir katına artırılabilecektir. Buna göre 7 yıl 6 ay olacak alt sınırdaki hapis cezası 1/2 oranında artırılırsa 11 yıl 3 ay; 15 yıl olacak üst sınırdaki hapis cezası bir kat artırılırsa 30 yıl olabilecektir. Mevcutta çocuğu araç olarak kullanma diye bir suç yoktu.

“Özgür Özel, algı çalışması yapıyor”

Ana Muhalefet Partisi Genel Başkanı Sayın Özgür Özel, özellikle 19 Mart’ta İstanbul Büyükşehir Belediyesi ile ilgili başlayan soruşturmaların başından itibaren tamamen konuyu, sanki bunlar bir adli soruşturmalar değilmiş, tamamen siyasi amaçla yapılmış soruşturmalarmış gibi bir algı çalışması yapıyor. 19 Mart’tan beri yaptığı bütün toplantılarda özellikle bu soruşturmaları eleştiriyor ama eleştirirken kamuoyuna yansıyan birtakım suçlamaları var.

İşte ortaya çıkan Beşiktaş iddianamesi var, İBB Başkanı’nın yaptığı, suç teşkil ettiği iddia edilen suçlamalar var. Bunların esasıyla ilgili herhangi bir şey söylemiyor. Tamamen suçlamaları reddediyor, bu doğru değil. Bunu yaparken de yargı mensuplarına hakaret ediyor, tehdit ediyor. Bunlar kabul edilebilecek bir şey değil.

Soruşturmaların sonucunu beklersiniz. Bu konuda iddialarla ilgili konulara açıklık getirirsiniz. İstanbul İl Başkanlığı ile ilgili olarak topladığınızı iddia ettiğiniz valiz dolusu paraların, nereden aldığınızı, nasıl toplandığını, kimlerin buraya getirdiğini gündeme getirmiyorsunuz. Sanki hiç ortada suç yokmuş; haksız bir şekilde üzerine gidiliyormuş bir algı oluşturuyor.

Yargılama aşamasında, iddianame ortaya çıktıktan sonra yargılama, ilk derecede de iş bitmiyor. Bunun istinafı var, itiraz süreçleriniz olacak, Yargıtay’ı var. Tüm bu süreçler kendi yargı mekanizması içerisinde yürüyecek konular. Ama tabii, olayı farklı bir tarafa çekerek, özellikle kamuoyunu bu davalar bakımından etkilemeye çalışan bir siyaset izleniyor. Bu doğru değil.

“Terörü sonlandırma noktasında önemli aşamalar kaydettik”

Türkiye Büyük Millet Meclisi’ndeki komisyonda konuşulanları açıklayamıyoruz, basına kapalı. Ülkemiz, terörle mücadelede gerçekten çok enerji kaybetti. 41 yıl geçti. Şehitler verdik, trilyonlarca kaybımız oldu, ülkemizin gelişmesinin ve kalkınmasının önünde çok büyük engel oldu terör.

İstiyoruz ki bundan sonra terör diye bir problemimiz kalmasın. Güvenlik güçlerimiz, ülke içinde ve dışında büyük fedakarlıklar gösterdiler. Terörü sonlandırma noktasında önemli aşamalar kaydettik. Teröre zemin hazırlayan, o teröre mazeret olarak gösterilen bütün unsurları ortadan kaldırdık. Demokratikleşme adımlarının atılması, Kürtçe yasaklarının kaldırılması zaten İmralı’nın çağrısında da bunlar ifade ediliyor. Hepsini söylüyor, diyor ki; ‘Artık bir anlamımız kalmadı.’ ‘Demokrasi için, demokratikleşme için, kimliğimizin var olması için mücadele ettik ama şu anda Türkiye oraları aştı’ diyor.

“Milli İstihbarat Teşkilatımız, Milli Savunma Bakanlığımız süreci izliyor”

Sayın Devlet Bahçeli’nin gruptaki çağrısı çok cesurca, tarihi bir çağrıydı. Sayın Cumhurbaşkanımızın hem Ahlat’ta ondan önceki konuşmalarıyla da bütünleştiği iç cephe vurgusu, milli birlik, kardeşlik vurgusu tüm bunlarla beraber yaklaşık işte 1 yıl geçti. Bu 1 yıllık süre içinde terör örgütü İmralı’da açıklama yapıldıktan sonra kendini feshetti. Silahları yakmayla ilgili bir görüntü gördük, çekilmeyle ilgili açıklamalar oldu. Burada silah bırakma süreci önemli. Milli İstihbarat Teşkilatımız, Milli Savunma Bakanlığımız süreci izliyor.

Diğer yandan Mecliste kurulan “Terörsüz Türkiye Komisyonu” dediğimiz, Milli Dayanışma, Kardeşlik ve Demokrasi Komisyonu da geniş kesimleri dinledi. Sivil toplumundan tutun da şehit ailelerine varıncaya kadar herkesi dinledi, bakanları dinledi. Meclisin yüzde 90’ının temsili sayesinde orada geniş bir mutabakat var. Bizler de Adalet Bakanlığı olarak bu süreci destekleyen, bu süreci kolaylaştıran, idari uygulamalarla neler yapıldığını Komisyona anlattık.

Mevcut mevzuatımız çerçevesi içerisinde yapılan çalışmaların çoğu kamuoyuna yansımadı. Ama uygulamalar, sürecin sağlıklı işlemesi ve sürecin kalıcı hale gelmesi bakımından da önemliydi. Gerek hasta hükümlü ve tutuklularla ilgili endişelerin ortadan kaldırılmasına yönelik çalışmalar, gerek idare ve gözlem kurullarının, cezaevlerinde iyi hal değerlendirilmesine ilişkin yaptıkları çalışmalar.

Bu süreçte özellikle yargı kurumlarının da sürece hassasiyetle baktıklarına şahit olduk. Sürecin kolaylaştırılması konusunda ki yapılan çalışmaları anlattık. Bir pazarlık değil, sürecin getirdiği adımlar olabilir. Yani terör örgütü silah bırakırsa kanun çıkacak gibi pazarlık söz konusu değil böyle hukuk devleti olmaz. Böyle bir pazarlık sürecine devlet girmez. Komisyon süreci önemli, herkes dinlendi. Rapor hazırlayacak ve orada çizilecek yol haritası çerçevesinde yasal düzenleme gerekiyorsa zaten Meclis bu konuda adım atacaktır. Burada özellikle milletimizin hassasiyetleri bizim için önemli. Bu sürecin onları rahatsız edecek bir noktaya gelmemesi önemli. Bu konuda özellikle hassas davranarak milletimizin isteği doğrultusunda biz yol alacağız.

“Selahattin Demirtaş hakkındaki AİHM kararı değerlendirilecek”

Selahattin Demirtaş hakkındaki AİHM kararı ulaştı mı istinafa? Şimdi Avrupa İnsan Hakları Mahkemesi’nin tek kararı değil bu biliyorsunuz. Yani Öcalan kararı da var geçmişte, Kavala kararı da var. Bakanlar Komitesi’nde görüşmeleri devam edenler de var. Burada Demirtaş ile ilgili dava Kobani Davası. Hepinizin bildiği gibi, Ankara 22. Ağır Ceza Mahkemesi’nde 16 Mayıs 2024 tarihinde Demirtaş ve arkadaşları mahkum olmuştu. Bir kısım sanıklar süreli hapis cezaları ve beraatler de almıştı. Kobani olaylarının azmettiricisi açılan dava 22. Ağır Ceza Mahkemesinde sonuçlanmıştı. Şimdi bu Ankara Bölge Adliye Mahkemesi 22. Ceza Dairesinde görülüyor.

Burada Avrupa İnsan Hakları Mahkemesi’nin özgürlük ve güvenlik hakkı ihlal edildi. Tutuklamaya yönelik ihlaller nedeniyle, iddia nedeniyle, Avrupa İnsan Hakları Mahkemesi Sözleşmesi’nin 5. maddesinin ihlal edildiği gerekçesiyle yapılan başvuruyu, Avrupa İnsan Hakları Mahkemesi 2. Dairesi ihlal kararı verdi. Bu daire kararına itiraz edilecek mi, edilmeyecek mi gibi bir kamuoyunda tartışmalar oldu.

Burada bu süreçlerde biz daire kararlarının Genel Büyük Dairede görüşülmesini istiyoruz. Büyük Daireye gitmeden önce 5 kişilik bir panel var. Bu panel ‘Görüşülmesine gerek yok’ dedi ve daire kararı bu anlamıyla kesinleşti. Daire kararı şu anda Bölge Adliye Mahkemesi 22. Ceza Dairesi tarafından değerlendirilecek.

“Türkiye’nin AİHM kararlarına uyma oranı yüzde 91”

Avrupa İnsan Hakları Mahkemesinin kararlarına uymayan bir ülkeyiz şeklinde bir genelleme yapılıyor. Bu doğru değil. Bütün ülkelerin uymadığı kararlar var. Avrupa İnsan Hakları Sözleşmesi’ne taraf olan ülkelerin karara uyma ortalaması yüzde 79. Türkiye’nin uyma oranı ise yüzde 91.

Türkiye’de bazı davalar, özellikle dışarıdan da çok siyasallaştırılıyor. O siyasallaştırılan davalar öne çıkarılarak sanki Türkiye’nin Avrupa İnsan Hakları Mahkemesi kararlarının hiçbirine uymuyor gibi bir algı çalışması yapılıyor.

İlk dereceden hüküm verildi, bu hüküm istinafta hükümözlü olarak devam ediyor. Yani dolayısıyla buradaki değerlendirme şu anda mahkemenin önünde. Mahkeme ne karar verecek hep beraber bekleyeceğiz.

“‘Artık darbeler devri kapanmıştır’ diyoruz”

Yeni Anayasa konusu Türkiye için önemli. ‘Türkiye Yüzyılı, Cumhuriyetimizin 2. yüzyılına girdik’ diyoruz. ‘Artık darbeler devri kapanmıştır’ diyoruz. Biz darbecilerin yazdırdığı bir Anayasayla yönetiliyoruz. Millet tarafından milletin temsilcileri tarafından yazdırılan bir anayasa değil. Millet oy verip kabul etmek zorunda kaldı ama bir an önce demokratik siyasi hayata geçebilmek için kabul ettiği bir anayasa. Sadece darbeciler tarafından yazdırılmış olması bile tek başına Anayasanın değişmesi için yeterli bir sebeptir.

Diğer yandan, yamalı bohça gibi; 170 küsur madde var, 180 değişiklik var. Yani, maddeden fazla değişiklik yapılmış. Mülga maddeler var, sıkıyönetimle ilgili maddeler var ama hep boş maddeler.

Bizim amacımız hem yeknesaklığı oluşturmak, sonradan oluşan kurumların diğer maddelerle uyumunu sağlamak, yeni krizlere yol açmamak, hem de demokratik, sivil, katılımcı bir anlayışla yeni anayasayı milletin temsilcileri ile yazıp millet tarafından onaylanmasını sağlamak.

Böyle bir Anayasa, Türkiye Cumhuriyeti Devleti’nin ikinci yüzyılının başlangıcında çok büyük kazanç olur. Temel hak ve özgürlükleri önceleyen, her kesimin kendini içinde bulduğu bir toplum sözleşmesi hüviyetinde bir anayasayı bu ülke yapabilir. Darbe anayasasından da kurtulmuş oluruz. Darbeleri anmak kötü bir şey. O eski karanlık günlere bir daha geri dönmeyelim, bu ülkede bir daha darbe olmasın diye önemli yapısal reformlar da yaptık.

İç Hizmet Kanunu 35. maddeyi hep darbelere gerekçe gösterirlerdi. Biz bu maddeyi 14 Temmuz’da yürürlükten kaldırdık. Ertesi gün darbe kalkışması oldu. En son görüştüğümüz kanun oydu Meclis’te. Sıkıyönetimi düzenleyen maddeler kaldırıldı, darbeciler yargılanamaz denilen maddeler kaldırıldı. Milli Güvenlik Kurulu’nun yapısı, Yüksek Askeri Şura’nın yapısı, askeri yargının kaldırılması bunlar çok demokratik adımlar. Ama bunlar hep muhtelif zamanlarda farklı gerekçelerle yapabildiğimiz ilerlemeler. Ama diyoruz ki artık topyekun millet Meclisinde milletvekillerimizin uzlaşmasıyla bir Anayasa yapalım. İnşallah olur.

Terörsüz Türkiye konuştuğumuz şu ortamda, milletvekillerimiz yeni anayasa çalışması içerisinde olursa ve bu konuda uzlaşma sağlanırsa inşallah milletimize olan borcumuzu yerine getirmiş oluruz.
