THE SUPREME COURT REGISTERED: “DEFAMATION CANNOT BE PROTECTED UNDER FREEDOM OF EXPRESSION”

Receiving a rejection response from the appeal, CHP took the final compensation decision to the Constitutional Court and made an individual application, alleging “violation of freedom of expression”. Examining the application on its merits, the Constitutional Court emphasized CHP’s position as the main opposition party and Berat Albayrak’s identity as a former minister and politician, and reminded that people in such positions should have wide limits of criticism.

Despite this, the Supreme Court stated that it is a democratic obligation to protect the rights of public figures not to be tarnished, to honor and reputation. In its justification, the Constitutional Court underlined that statements that are not based on a factual basis and directly contain concrete criminal charges cannot benefit from the constitutional protection shield.

EMPHASIS WAS MADE TO THE INDEPENDENT AND AUTONOMOUS STRUCTURE OF THE CENTRAL BANK

In the decision of the Constitutional Court, it was determined that the allegations in the publication carried out by the CHP could not be described as simple value judgments, on the contrary, they were factual accusations indicating direct action.

It was also reminded that the Central Bank has a completely independent and autonomous structure in terms of administrative and financial terms in accordance with the legal legislation, and its own monetary policies and all financial transactions are decided by the bank’s own authorized boards. Acting within this legal framework, the Constitutional Court registered that no direct and legal connection could be established between the allegations made by CHP as propaganda material and the person of former Minister Berat Albayrak, that is, the allegations produced were completely empty.

APPROVAL OF THE COMPENSATION DECISION FROM THE Constitutional Court

As a result, the Constitutional Court confirmed that the local courts made a very fair and balanced assessment between the CHP’s right to express its opinion and Berat Albayrak’s personal rights. Stating that the 40 thousand lira non-pecuniary damage awarded was proportionate and the intervention was lawful, the Constitutional Court ruled by majority vote that the freedom of expression regulated in Article 26 of the Constitution was not violated.

Other claims of CHP lawyers that the principles of fair trial and equality of arms were violated were unanimously rejected by the Supreme Court as clearly unfounded. Thus, the judicial bodies, which found the compensation decision in favor of Berat Albayrak appropriate, confirmed at the highest level that the lie of 128 billion dollars, which the main opposition has been maintaining for a long time, is unfounded.
